CBBCA WAIVER AND RELEASE OF LIABILITY

I agree to abide by all rules and regulations of the Constance and Buckham’s Bay Community Association Inc. (“CBBCA”) and the City of Ottawa and to use all facilities and equipment safely and as intended. I understand that participation in CBBCA programs/events (including pickleball) involves physical activity with inherent risks, including injury or death, arising from causes such as falls, collisions, overexertion, equipment failure, environmental conditions, and the actions or negligence of myself or others. 

I confirm that I am physically able to participate, have no condition that would prevent safe involvement, and will use appropriate protective equipment as required; I acknowledge that I should consult a physician if I have concerns. I voluntarily assume all risks associated with participation. 

In consideration of being permitted to participate, I hereby release, waive, and discharge the CBBCA and the City of Ottawa, and their directors, officers, employees, volunteers, agents, and contractors, from any and all claims for injury, loss, or damage, including death, arising from participation, whether caused by negligence or otherwise, and I agree to indemnify and hold them harmless from any such claims. 

I understand that no medical services are provided and I am responsible for any medical costs incurred. I acknowledge that participation is voluntary, that I have read and understand this agreement, and that I am waiving certain legal rights, including the right to sue.

I confirm that I am 18 years of age or older.
